Sweden keeps sex-change sterilization law

    A move to scrap Swedish laws requiring compulsory sterilization for people undergoing gender reassignment surgery has been put on ice following opposition from the Christian Democrats.

    Quite odd really since hormone therapy largely renders both M2F and F2M transsexuals sterile and the orchiedectomy in trans women and hysterectomy in trans men renders complete sterilisation anyway. I wonder what they are thinking about.

    The latest news coming out from Sweden is that the Swedish Christian Democrat party has abandoned its support for the rule which requires transgender people to be sterilised before the state recognises their gender and so cleared the way for repeal.

    Sweden has now abandoned this act which was overturned when Simon Leivo won a judgement allowing him to be registered as a male without having to have a vasectomy.  A statement read:-

    Forced sterilization was abolished!
    In an earlier judgment, the Court ruled that the requirement for sterilization for legal change of sex is any physical violation. The requirement is in conflict with the ECHR and therefore should not apply.
    The requirement for sterilization has been around since 1972 in the so-called sex law. Discrimination Office Uppsala, DU, has since the fall of 2010 represented Simon Leivo who submitted an application to change legal gender to be. National Board rejected the application because Simon did not want a vasectomy.
    YOU have said that this is contrary to the right to privacy enshrined in the Convention. Today, got TO the judgment of the administrative law where Simon is given the right. Auditors states that the requirement conflicts with the ECHR and therefore should not apply. First, in February this year the Minister of Social Affairs to the 40-year-old statutory requirement for sterilization at legal change of sex to finally be abolished because it violates human rights. YOU say that judgment is of great importance.
    -I think it's important for everyone involved in the question that the judiciary has taken a position and we get confirmation that the European Convention's protection of human rights in practice apply. Now maybe we can finally put an end to forced sterilization in Sweden, says Kerstin Burman, attorney at DU.
    For Simon is the judgment that he is entitled to obtain legal status as a man without submitting to any requirement for sterilization.
    -I can not believe it's true. It is a great victory on an issue that affects very many people, says Simon.
