Access to and use of this site ('gendersociety.com') are subject to the following terms and conditions:
By
using The Gender Society you agree to be legally bound by our terms and
conditions, which shall take effect immediately on your first
use of The Gender Society. If you do not agree to be legally bound by
all the following terms and conditions please do not access
and/or use The Gender Society.
The Gender Society may change these terms and conditions at any time
by posting changes online without notice. Please review these
terms and conditions regularly to ensure you are aware of any
changes made by The Gender Society. Your continued use of The Gender Society after
changes are posted means you agree to be legally bound by these
terms and conditions as updated and/or amended.
Email
To become and remain a Gender Society member you need to have a valid and working email address where you can be contacted. Please ensure that the email address you use at registration and subsequently, is one at which you can easily receive email from The Gender Society without being in trouble with:
a) Your boss
b) Your wife / partner / SO / children / auntie / another person who will not understand
Please do not use a Gender Society email address as your contact address.
As a member you agree to receive your password details, The Gender Society Tribune (our monthly newsletter), forum notifications and various other communiqués via email, although we will never bombard you with spam.
PLEASE NOTE THAT AT The Gender Society WE HAVE THE UTMOST INTEGRITY. YOUR PRIVACY IS OF THE GREATEST IMPORTANCE.
WE WILL NEVER SELL OR PASS ON YOUR INFORMATION TO OTHER COMPANIES. YOUR PERSONAL DETAILS ARE NEVER DIVULGED TO ANY THIRD PARTIES.
General
The goal of The Gender Society is to provide an interesting, stimulating, educational and fun place for transgender people, their significant others and their admirers. In keeping with this goal, you, as a user of The Gender Society’s services, must agree to abide by these Terms and Conditions. By accessing the The Gender Society community with a Username and Password, you agree to accept these Terms and Conditions. You agree that any Username and Password you choose or are assigned will not be transferable and can only be used by you. If you violate any of the Terms and Conditions, your access to The Gender Society may be suspended or terminated without notice. This suspension or termination is at the sole discretion of The Gender Society.
Use
of The Gender Society
You may not copy, reproduce, republish, download, post, broadcast,
transmit, make available to the public, or otherwise use Gender Society
content in any way except for your own personal, non-commercial
use. You also agree not to adapt, alter or create a derivative
work from any Gender Society content except for your own personal,
non-commercial use. Any other use of Gender Society content requires
the prior written permission of Gender Society management.
You agree to use The Gender Society only for lawful purposes, and in
a way that does not infringe the rights of, restrict or inhibit
anyone else's use and enjoyment of Gender Society. Prohibited behaviour
includes harassing or causing distress or inconvenience to any
person, transmitting obscene or offensive content or disrupting
the normal flow of dialogue within The Gender Society.
Neither
The Gender Society nor any providers of information make any warranties,
express or implied, as to results to be obtained from use of
such information, and make no express or implied warranties
of merchantability or fitness for a particular purpose or use.
Neither The Gender Society nor any of its providers of information shall
have any liability for the accuracy of the information contained
in the service, or the contents of any advertisements, or for
assertions or omissions therein. No party shall be liable to
any other party or any third-party for third-party claims or
losses of any nature, including, but not limited to, lost profits,
punitive or consequential damages.
The Gender Society
reserves the right to remove any listings or any advertisements
for any reason. In no case shall The Gender Society be liable for any
costs or events that occur beyond its control including, but
not limited to, network outages, Internet connectivity problems
and client side browser issues.
The
following disclaimer and terms of use apply generally to all
postings to the Gender Society site. It is hereby also understood
that any person posting to The Gender Society will have read this disclaimer
and terms of use prior to doing so and, as such, be subject
to its terms as indicated below.
Disclaimers
and Limitation of Liability
Gender Society content, including the information, names, images,
pictures, logos and icons regarding or relating to The Gender Society
and/or its products and services (or to third party products
and services), is provided "AS IS" and on an "IS
AVAILABLE" basis without any representations or any kind
of warranty made (whether express or implied by law) to the
extent permitted by law, including the implied warranties of
satisfactory quality, fitness for a particular purpose, non-infringement,
compatibility, security and accuracy.
Under no circumstances will The Gender Society be liable for any of the
following losses or damage (whether such losses where foreseen,
foreseeable, known or otherwise): (a) loss of data; (b) loss
of revenue or anticipated profits; (c) loss of business; (d)
loss of opportunity; (e) loss of goodwill or injury to reputation;
(f) losses suffered by third parties; or (g) any indirect, consequential,
special or exemplary damages arising from the use of The Gender Society
regardless of the form of action.
The Gender Society does not warrant that functions contained in Gender Society
content will be uninterrupted or error free, that defects will
be corrected, or that The Gender Society or the server that makes it
available are free of viruses or bugs.
Conditions of Use
The Gender Society is supposed to be a fun community. There is no
room here for hotheads who are simply looking for a fight. You
are entirely responsible and liable for all your postings to
The Gender Society, whether in the forums, the chat rooms, the intra-site
messenger system, the anonymous email system or elsewhere. Listed
below are some, though not all, violations which may result
in The Gender Society deleting your postings and /or terminating your
membership. You agree not to carry out any of the following
actions while posting messages to The Gender Society.
- Harass,
intimidate, threaten, embarrass or slander any person or entity;
- Transmit
via The Gender Society any information, data, text, files, links, software,
chat, communication or other materials ("Content")
that The Gender Society considers to be unlawful, harmful, threatening,
abusive, harassing, defamatory, vulgar, obscene, hateful,
racially, ethnically or otherwise objectionable;
- Impersonate
at The Gender Society, any business or person, living or dead, famous
or not;
- Intentionally
or unintentionally violate any applicable local, state, national
or international law, including but not limited to any regulations
having the force of law while using or accessing The Gender Society
or in connection with your use of The Gender Society in any manner.
Intellectual Property
You agree that you will not upload or transmit any content to
The Gender Society that infringes any patent, trademark, trade secret,
copyright or other proprietary rights ("Rights") of
any party. By submitting content to The Gender Society you automatically
grant or warrant that the owner of such content has expressly
granted The Gender Society the royalty-free, perpetual, irrevocable,
non-exclusive right and license to use, reproduce, modify, adapt,
publish, translate, create derivative works from, distribute,
perform and display such content (in whole or part) worldwide
and/or to incorporate it in other works in any form, media,
or technology now known or later developed for the full term
of any Rights that may exist in such content.
By
submitting your contribution to The Gender Society, you warrant that
your contribution;

is your own original work and that you have the right to make
it available to The Gender Society for all the purposes specified
above;
- is
not defamatory; and
- does
not infringe any law; and
-
indemnify The Gender Society against all legal fees, damages and
other expenses that may be incurred by The Gender Society as a
result of your breach of the above warranty; and

waive any moral rights in your contribution for the purposes
of its submission to and publication on The Gender Society and the
purposes specified above.
The
names, images and logos identifying The Gender Society or third parties
and their products and services are subject to copyright, design
rights and trade marks of The Gender Society and/or third parties. Nothing
contained in these terms shall be construed as conferring by
implication, estoppel or otherwise any licence or right to use
any trademark, patent, design right or copyright of Gender Society
or any other third party.
Content
You must evaluate, and bear the risk associated with, the accuracy,
completeness or usefulness of any content. The Gender Society shall not
be responsible for any content. The Gender Society does not prescreen
or monitor all content as a matter of policy, but The Gender Society
shall have the right, but not the responsibility, to remove
content which is deemed in sole discretion harmful, offensive,
or otherwise in violation of this Agreement or any rules The Gender Society
has in place at the time. The Gender Society may elect at its sole discretion
to monitor some, all, or no areas of The Gender Society for adherence
to this Agreement or rules.
Disclaimer of Warranties
You expressly agree that use of The Gender Society is at your own risk.
The Gender Society shall not be responsible to you for any content found
on The Gender Society. The Gender Society expressly disclaims all warranties of
any kind, whether implied warranties of merchantability, fitness
for a particular purpose, and noninfringement. The Gender Society makes
no warranty that The Gender Society will be timely, secure, error free,
or meet your requirements; nor does The Gender Society make any warranty
as to the results that may be obtained from the use of The Gender Society
or as to the accuracy or reliability of any information obtained
through The Gender Society. No advice or information, whether oral or
written obtained by you from The Gender Society shall create a warranty
not expressly made herein. You understand and agree that any
content downloaded or otherwise obtained through the use of
The Gender Society is done at your own discretion and risk and that you
will be solely responsible for any damages to your computer
or loss of data that results in the downloads of such content.
To the full extent permissible under the applicable law, The Gender Society
shall not be liable for any direct, indirect, incidental, special
or consequential damages resulting from the use or inability
to use The Gender Society or for the cost of procurement of substitute
goods and services resulting from any goods or services purchased
or obtained through your use of The Gender Society.
Membership
and Termination of Membership
Membership termination requests are normally processed once
a week. Please be aware of this when requesting account closure.
We also reserve the right to terminate any member's account
at any time without notice and without explanation (although
in practice, members who contravene our rules will be warned
on several occasions before their accounts are closed and an
explanation will normally be given). In the event of the closure
of The Gender Society (something we hope will never be necessary), membership
refunds will not be available, outside our thirty day guarantee
period. We also reserve the right not to grant membership without
explanation, to users for whom we determine that Gender Society membership
is inappropriate.
Gender Society
Community Rules
You agree to use The Gender Society Communities (including Message Boards)
in accordance with the following Community Rules. These apply
across all Gender Society community sites and services.
About
your posts:
- Contributions
must be civil and tasteful
- No
disruptive, offensive or abusive behaviour: contributions
must be constructive and polite, not mean-spirited or contributed
with the intention of causing trouble.
- No
unlawful or objectionable content: unlawful, harassing,
defamatory, abusive, threatening, harmful, obscene, profane,
sexually oriented, racially offensive or otherwise objectionable
material is not acceptable.
- If
you use multiple logins for the
purpose of disrupting the community or annoying other users
you may have action taken against your accounts.
- Be
patient: users of all ages and abilities may be taking
part in the relevant Gender Society Community.
- No
spamming or off-topic material: we don’t allow the
submission of the same or very similar contributions many
times. Please don't re-submit your contribution to more than
one discussion, or contribute off-topic material in subject-specific
areas.
- No
advertising
- No
impersonation
- No
inappropriate (e.g. vulgar, offensive etc) user names
- You
may not refer to specific URLs (web site addresses).
If you know of a worthy web site relevant to the discussion
topic, please inform the host of the Community area.
Safety:
We
advise that you never reveal any personal information about
yourself or anyone else (for example: telephone number, home
address or email address), and please do not include postal
addresses of any kind. If you have a helpful address to share,
inform the host of the relevant Community area using our Messenger
facility, and they will promote it if they see fit.
About
the law:
- You
may not submit any defamatory or illegal material of any nature
in Gender Society Communities. This includes text, graphics, video,
programs or audio.
- Contributing
material with the intention of committing or promoting an
illegal act is strictly prohibited.
- You
agree to only submit materials which are your own original
work. You must not violate, plagiarise, or infringe the rights
of third parties including copyright, trade mark, trade secrets,
privacy, publicity, personal or proprietary rights.
- The
views expressed in Gender Society Community areas are those of
members of the public and are not necessarily those of The Gender Society.
Full Membership Billing:
All Full Membership payments are handled through PayPal and PayPoint subscriptions which automatically renew either monthly, quarterly or annually so you will be automatically billed at the end of your term for the next month quarter or year if your subscription is still active. You can, however, cancel your subscription at any time from within your PayPal or PayPoint control panel. You can also request a cancellation by contacting us but be sure to give us your correct user name. If you do not cancel by the end of your term, you will be automatically billed for the next term

If
you breach these Terms of Use:
If
you fail to abide by these Community Rules (and/or any variations
in the relevant local house rules) when taking part in a Gender Society
Community service, you may receive a warning that continuing
to break the rules may result in action being taken against
your account or accounts.
This
action may include your relevant account or accounts being
placed into a temporary or permanent suspension of your ability
to participate in any or all of the Gender Society Community areas. In extreme cases, your membership account may be terminated and you may be banned from the community.
If
you post or send offensive or inappropriate content anywhere
on or to Gender Society Communities or otherwise engage in any
disruptive behaviour at The Gender Society, and The Gender Society considers
such behaviour to be serious and/or repeated, The Gender Society may
use whatever information that is available to it about you
to stop any further such infringements. This may include informing
relevant third parties such as your ISP or email provider
about the infringement/s.
The Gender Society
reserves the right to delete any contribution, or take action
against any account, at any time, for any reason and without notice.
And Finally:
If
there is any conflict between these terms and specific terms
appearing elsewhere on The Gender Society (including local house rules)
then the latter shall prevail.
If
any of these terms are determined to be illegal, invalid or
otherwise unenforceable by reason of the laws of any state or
country in which these terms are intended to be effective, then
to the extent and within the jurisdiction in which that term
is illegal, invalid or unenforceable, it shall be severed and
deleted from these terms and the remaining terms shall survive,
remain in full force and effect and continue t
be binding and
enforceable.
The Gender Society site is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and noninfringement. In no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with this site, it's software or content.
We reserve the right to add to, remove and change the features offered by The Gender Society at any time and without notice.
These
terms shall be governed by and interpreted in accordance with
the laws of England and Wales.
We
